Terms of Service

"We"/"us"/"our" is Seamlessly Apparel, which operates this store (the "Services"), powered by Shopify. These Terms, with our Privacy Policy, govern your use of the Services. By using the Services you agree to both; if not, don't use them.

1. Access and Account  You must be of legal age (or have consented for a minor dependent to use the Services on your device). Information you provide (email, billing, shipping, payment) must be accurate and complete. You're solely responsible for your account's security and activity, and may not transfer or sell your account.

2. Products  We aim for accurate product representations, but colors/appearance may vary by device. Descriptions can change without notice; we may discontinue products or limit quantities at our discretion.

3. Orders  Placing an order is an offer to purchase, which we may accept or decline. Orders aren't final until confirmed and paid; cancellations may not be possible after acceptance. We'll try to notify you of any changes/cancellations via your provided contact details. Returns/exchanges follow our Refund Policy. Purchases must be for personal/household use, not resale or export.

4. Prices and Billing  Prices/promotions can change without notice; the price at order time (per your confirmation email) applies, excluding taxes/shipping/customs unless stated. Promotion-specific terms override these Terms if they conflict. You must keep your payment/account info accurate and current, and confirm your payment method is valid, authorized, and will be honored, and that you'll pay all charges including tax and shipping.

5. Shipping and Delivery  Delivery times are estimates, not guarantees; we're not liable for carrier, customs, or other delays outside our control. Risk/title transfers to you once we hand off to the carrier.

6. Intellectual Property  All content, trademarks, and designs on the Services belong to Seamlessly Apparel (or its licensors/affiliates) and are protected by IP law, for your personal, non-commercial use only. No reproducing, distributing, modifying, or republishing without our written consent; no license is granted beyond what's stated here. Unauthorized use may violate IP law. Our names/logos/trademarks (and Shopify's, and other owners') may not be used without permission.

7. Optional Tools  Third-party tools offered through the Services are provided "as is," without warranty or endorsement; use is at your own risk, and you should review the relevant third party's terms. New features we add later are also covered by these Terms.

8. Third-Party Links  We don't vet or take responsibility for third-party sites/content linked from the Services; accessing them is at your own risk. Direct complaints about third-party products/services to that third party.

9. Relationship with Shopify  Shopify powers our Services, but sales are between you and us directly. Shopify has no responsibility for those sales, and you release Shopify from related claims.

10. Privacy Policy  Our Privacy Policy and Shopify's Privacy Policy govern collection/use of your personal data; using the Services means you've read both. Shopify (as host) processes your data, which may be shared with Shopify and international third parties, to provide/improve the Services.

11. Feedback  Any feedback/ideas you submit grant us a perpetual, worldwide, royalty-free license to use for any purpose, commercial included, with no obligation to compensate you, keep it confidential, or respond. We may (but need not) moderate feedback. You warrant your feedback is your own, lawful, non-infringing, and not misleadingly submitted; you're solely liable for it and we assume no responsibility for user feedback.

12. Errors, Inaccuracies, Omissions We may correct errors (pricing, descriptions, availability, etc.) or cancel affected orders anytime without notice, even after you've ordered.

13. Prohibited Uses  You may only use the Services lawfully. Prohibited: unlawful/malicious use; violating laws or IP rights; harassment or defamation; transmitting false info or spam; impersonation; disrupting others' use; uploading malware; unauthorized copying/reselling of content; harvesting personal data; using bots/scrapers/AI tools to access the Services; or bypassing security measures. Violations may result in account suspension/termination without notice.

14. Agents  Automated "Agents" accessing the Services must self-identify (via user agent string "Agent/[name]"), never impersonate a human or bypass CAPTCHAs/anti-bot measures, answer truthfully about being automated, and not circumvent any access controls. We may restrict Agent access by any means, or by explicit request.

15. Termination We may terminate this agreement or your access anytime, without notice, at our discretion; you remain liable for amounts owed. Sections on IP, Feedback, Termination, Warranty Disclaimers, Liability Limits, Indemnification, Severability, Waiver, Entire Agreement, Assignment, Governing Law, and Privacy survive termination.

16. Disclaimer of Warranties  Content is for general information only; we don't warrant its accuracy and disclaim liability for reliance on it. Services/products are provided "as is"/"as available," with no warranties of merchantability, fitness for purpose, title, or non-infringement, and no guarantee of uninterrupted, timely, or error-free use (subject to any jurisdictional limits on such disclaimers).

17. Limitation of Liability  To the fullest extent permitted by law, Seamlessly Apparel, its people, and Shopify aren't liable for any direct, indirect, incidental, punitive, special, or consequential damages (lost profits, revenue, savings, data, etc.) arising from your use of the Services or products, regardless of legal theory, even if warned of the possibility.

18. Indemnification  You agree to indemnify and hold harmless Seamlessly Apparel, Shopify, and related parties from third-party claims/losses/costs arising from your breach of these Terms, violation of law/others' rights, or use of the Services. We'll notify you of claims, may control defense/settlement (without imposing non-monetary terms on you without consent), and you must cooperate.

19. Severability  If any provision is found unenforceable, it will be enforced to the extent allowed, and the rest of the Terms remain valid.

20. Waiver; Entire Agreement  Not enforcing a right isn't a waiver of it. These Terms (plus referenced policies) are the entire agreement between you and us, superseding prior agreements, and won't be construed against whoever drafted them.

21. Assignment  You can't assign/transfer these Terms without our written consent; we may assign them freely.

22. Governing Law These Terms are governed by the laws of, and subject to the courts in, our jurisdiction of headquarters; both parties consent to that venue.

23. Headings  Section headings are for convenience only and don't affect interpretation.

24. Changes to Terms  We may update these Terms anytime by posting changes here; check periodically. We'll notify you of material changes as legally required. Continued use after changes = acceptance.
